Long story ahead...
I bought a 2nd hand Mercedes C350 Diesel from a dealer in Edenvale... will withold names for now but its a big dealership not a fly by night next to the road.
On the way home picked up a couple of faults...
Engine light came on
Vibration on the car @ 120
Brake shudder @120
Aircon wouldn't adjust from upper to lower etc.
Wipers not working on intermittent setting- they replaced the windscreen
The car went back to the dealer, no fighting required, to sort out the issues.
I received the car back with them stating the engine light just required a reset and test.
They cant feel the vibration
The aircon and rain sensor/wipers has been sorted.
And they skimmed the discs.
On the way home it started raining and lo and behold wipers not working as they should.
Car still vibrates... they claim they can't feel it, I stop at a tire shop and have the wheels balanced... all 4 wheels are bent.. And the brake shudder returns within 500kms.
The car goes back once again for the vibration, send the rims off for repair... get the car back with the vibration now worse than before. And being felt through steering. I noticed the front and rear tires has been swapped. I let them know its still vibrating. Ill bring it back
Drive the car from the thursday to the sunday... then suddenly the AC stops cooling completely.
Car goes back for the aircon and the vibration. The car is there for a week when i get feedback the AC pump needs to be reconned. I again need the car. Pick it up friday and arrange for the car to go back on the wednesday as the AC specialist can only help then.
Car goes back again... I supply Brake disc and pads to cure the shudder, they then quote me labour to fit them... car then stands at the dealership for 2 weeks being repaired. They replace the AC pump and AC condensor. They send the rims back in again for straightening. And they have the people who fitted the windscreen come and check out the windscreen rain sensor for the wipers that don't work.
I pick up the car 2 weeks later... AC works and I'm assured over a call that they are now driving my car and can't feel a vibration. The wipers also work as they should according to the salesmen.
So pick up the car and the AC does work as it should... but the car still vibrates and the wipers don't work as they should.
Give them a call on the way home about the problems and I get told by the salesman that I should rather give the car back cause I'll never be happy.
I take videos confirming the car still vibrates and the wipers don't work as they should.
Less than 3 days later... aircon stops working again.
Im at my wits end with this dealership and car.
So my real question do I let them try and fix it again...
OR can I Use the CPA to give the car back and cancel the Deal and finance.
The have allways been willing to fix it. But I bought the car on the 22nd of december. And the have had the car for more than 5 weeks now in total.
I can't keep on taking off work to have them try and fix the issues.

If you think this is taking much of your time and money, wait till you start to litigate.

What is taking you so long? return the car.
Problem is they don't want to cancel the deal with the bank. Telling me it's my problem to cancel the finance with the bank.

If you arranged the finance it is your problem. If they did i assume they will sort it out,either way probably a penalty to pay for early termination.

Give it back because there is a reason why all 4 rims is damaged and if you know that maybe you will not want to drive the car any further. Just inform the bank about the reasons you are giving the car back and they will immediately cancel the contract. It sound to me if this vehicle was mis used in the first place by the previous owner.
