Golden rule is to stick to facts without becoming emotional. If you post facts that are true, without using derogatory terms such as skelms, thieves, useless idiots etc, then you cannot be held liable. You can then respond to the lawyer that your facts are true, you stand by them and you suggest he advises his client fully on the law surrounding defamation because if not, you will defend any action and seek an appropriate cost order.

But you can only do that if you know what you have stated is true. Rather say "they refused to pay my claim and according to me such refusal is contrary to the policy contract" than saying "they are in cahoots and don't pay out anyone" - (this is just an example - not aimed at the OP of today's complaint).

That is why I really hope that Mr MMG will come and post the facts (with timeframes etc).

Many rants posted on the then forum in the past were handled amicably here ie a rant posted was then proven wrong by TS Raymond,no lawyer letters or threats of lawyer letters being sent. The poster always gave the end of the story and not beginning, middle and end which led to many arguments here.

Now I just see a rant and read of lawyers letters being sent? Surly to prove someone wrong bring in facts, to threaten brings animosity and loss of support. Just saying.

I don't think the average Joe on this forum understands the consequences of slander on social media. I would also protect myself or my business with legal action/legal letter in certain instances.

I was stuck WITHOUT a satphone (I ordered from Tuffstuff and they messed up by not providing the satphone that they advertise and gave me a lame excuse that I did not receive an invoice). I used to think Tuffstuff was good until now. They do not have reliable assistance in other countries outside our border and use unreliable contractors. I was stuck in the Central Kalahari and the breakdown truck that Tuffstuff sent broke down as well. I spent a night with my young son at the Matwere Gate withou communication from Tuffstuff. This is the second time that one of their tow vehicles have also broken down. I will explain all the issues I experienced with Tuffstuff in an upcoming trip report.

If you value the lives of yourself, your family and your vehicle, I suggest going to a reputable insurer with adequate coverage and avoiding Tuffstuff coz when you need them they will disappoint you.

The poster has been on the forum before - with 600 odd posts. Most posts relating to this insurer, on this forum, have been really positive and, anyone reading it would realise that they are generally very well respected and liked.

Why on earth would you expect a positive, respectful response when you post as he did? He, sorry to say, deserves the flack that he gets.

When considering short term insurers, maybe have a look at pages 19 & 20 of this report:

    https://www.osti.co.za/media/1229/os...eport-2017.pdf

Out of interest, the Short-term Ombud overturned 20.14% of complaints in 2017 (thus ruled in favour of the insured) for the industry as a whole.

Western National (the Insurer behind TS) had an overturn ratio of 23.23%. So not bad compared to the industry and a big insurer like Santam (21.58%) but not great either.

Outsurance has always done very well on this report.

The insurance industry is well regulated.

Posting accusations and emotional statements that damage the reputation of a service provider on a public forum is just plain stupid and very "skoorsoekerig"

I am not a TS client - so my comment is not about their service

The division of members is very apparent when it comes to TS, which does not contribute at all to keep this community happy and healthy.

It is clear that it is fine to complain about some companies/institutions, and not others. This is unfair practice. Since the human beings on this forum (as any other forum) are simply not able to pick the right ones to moan about and leave the wrong ones alone - the only option would be to discourage any complaining. And the person who wins the contract to make the popcorn can retire a rich man.

Full disclosure, I am a ts client.

I do disagree with you though. Raymond has always been willing to address issues privately or here, However you cannot post emotion laden rants without all of the information and then cry bully.

There is no protection of members here. Commercial, long standing, new. It doesn't matter. The mods keep us all on the straight and narrow path.
