    @Hylton: I've been driving Landies since pa fell off the bus, have taken my Landies to a number of workshops over the years and found that (IMHO) the best Landy Indie is situated in Hermanus. Not the cheapest, but the best. I don't know whether it is politically correct to name him here, but if I could, I would.

    As the vehicle was willingly handed over its not theft.

    It's a civil matter - failure to honour a contract.

    At best you might get some fraud for the transfer papers, but even that can be argued as being an authorized person as he was given permission to sell the vehicle.

    What I see here though - just goods know he has sold for people and not paid - myself, 2 others and the cruiser that I know of - is pushing R200k. I hear there are many more , but those are confirmed!

    And he has / had plenty of work.

    This is not a case of a failed business - the money was there. Something is very screwy as they say.

    Agreed, something very screwy. He had a busy workshop and a loyal customer base.
    I just spent R20 K fixing what I had paid him to do.
    He had a viable business so cheating his customers was unnecessary.

    It is not theft, but fraud through misrepresentation. Unfortunately the buyer is going after the seller to get the registration documents instead of cornering Jakes. I suspect he is a buddy and doesn't want to confront Jakes, who of course hasn't got the papers, because he never handed over the money he received from the buyer to the seller. As I said, the case is in the hands of the law, everyone is going to lose.

    Many moons ago i investigated a case that is very similar to this one. The guy, a panel beater, also by means of fraud got hold of the license papers after the vehicle was left at his place for repairs.He told the owner that someone wanted to buy the vehicle. Owner told him that he will only sell and hand over paper work once there is money in his account.

    He then sold the vehicle without paying the money over to the original owner. He was charged with Theft of a motor vehicle as well as fraud. Found guilty on all charges.

    I had a thing last year where a guy sold me spares an didnt deliver (see thread - gumtree skelms)

    The charge was Fraud with criminal intent - Edward Zaayman is now sitting for 15 years

    I first spoke to a lawyer buddy (he also drives a Landy so he cant be that bad)
    and then I laid a charge at the Tableview police station (the most jacked station in SA)
    They in turn contacted the George station and gave me regular updates (Tableview)until the inspector in George called to say that she was on her way to Cape Town to take my statement
